These terms and conditions are agreed between SCSC, a company with capital of 1,500 Euros, registered office located at 55 rue Deguingand 92690 Levallois-Perret; listed on the Nanterre companies and trade register under the number B 431 960 004 and hereafter known as “The Company” and any person or organisation wishing to make a purchase via the website www.boutiqueofficielle-toureiffel.com, hereafter known as “The Customer”.

Article 1 – General conditions of sale and scope of application

These terms and conditions apply to all orders placed on the www.boutiqueofficielle-toureiffel.com website. The Company reserves the right to alter or modify these terms and conditions, without notice. In terms of modifications, the terms and conditions in force on the day each order is placed shall be applied. Clicking on the “confirm” button at the end of the order process implies full and unreserved acceptance of all terms and conditions and equates to an electronic signature, which carries the same validity as a handwritten signature.
The Customer receives an automatic order confirmation by electronic mail.

Article 2 – Duration of validity of offer for sale of goods and services

Goods and services are offered for sale on the site for as long as it is online and while stocks last.

Article 3 - Prices

The prices of our products are marked in euros, including VAT, but excluding shipping. They are payable in euros. Shipping costs are calculated after the order is placed, according to the article(s) ordered and the country to which the order is to be shipped.

Prices on the site are in euros, including taxes and VAT at the rate in force on the day of the order. Any change to the rates of taxation may be passed on to the prices of goods and services.

The Company reserves the right to modify prices without notice, whilst recognising that the price on the site on the day of the order is the only price applicable to The Customer.

Article 4 - Payment

Purchases may only be paid for by credit/debit card (all VISA, Mastercard, Maestro, etc cards are accepted) in euros including taxes. Payment is made directly from the bank. Transactions are monitored and recorded by La Banque Postale, which provides the “Scellius” secure payment system. Once payment is approved by the bank, the order becomes effective. If the bank refuses payment, The Company automatically cancels the sale in progress.

All banking transactions are secured using SSL (Secure Socket Layer) technology that encrypts The Customer’s personal data. Neither The Company nor any third party has access to the banking data as it is sent over the network.

Article 5 – Duty and taxes

All orders placed on the site and delivered outside France may be subject to taxes and customs duty, levied when the parcel arrives at its destination. The Customer is liable and responsible for these taxes and customs duties, which are connected to the delivery of an article. The Company is not obliged to verify or inform The Customer about applicable taxes or customs duties. The Customer is advised to contact the relevant authorities in the destination country in order to find out about the taxes and duties due.

Article 6 – Right of retraction

In compliance with article L 121-20 of the Consumer Code, The Customer has a cooling-off period of seven full days from the date of receipt of the parcel, during which he or she may return the articles, at his or her expense, to The Company at the following address: SCSC – Garonor Est – BP641 – 93611 Aulnay sous Bois, France. This cooling off period also applies during the period after the order is placed and before it is delivered. A refund will be provided as soon as possible, and no later than thirty days following implementation of the right of retraction. Goods will only be accepted for return if returned in their original condition (including packaging, accessories, manuals, etc). They must be complete, in good condition and accompanied by a copy of the purchase invoice. Articles returned by The Customer that are incomplete, spoiled, damaged or soiled will not be accepted. The cost of return articles in this instance will be at The Customer’s expense.

Article 7 – Product Guarantees

Our suppliers guarantee the authenticity of their products. The description of the goods found on the site corresponds to that supplied by the manufacturer/supplier, who is solely responsible for the accuracy of this information. Pictures of the products on the site are non-contractual. The Company accepts no responsibility where the goods delivered do not comply with legislation in the destination country, except in France.

 

Article 8 – Damaged goods

Where one or more products are found to be damaged on arrival, The Customer must inform The Company, using the form available on the site under the “Contact” section, within 3 days of receipt of the product. The Customer must then return the damaged goods within seven days to the following address: SCSC – Garonor Est – BP641 – 93611 Aulnay sous Bois, France. On receipt of the goods, The Company will refund the full amount for the damaged item(s), as well as the original shipping cost, and the cost of return incurred by The Customer. Details of refund methods are included in Article 9.

 

Article 9 - Delivery

Products purchased on www.boutiqueofficielle-toureiffel.com will only be delivered to countries listed in the drop-down menu on the site, these being the countries to which our “shipping supplier”, TNT, delivers. Goods are delivered to the shipping address provided by The Customer during the placing of the order. Once the order has been prepared, the parcel is handed over to TNT, which then sends an automatic confirmation email to The Customer, giving details of a website and parcel reference number for delivery tracking purposes. Delivery times are as follows: 2 working days for France, 3 working days for other countries in the European community, 4 to 6 working days for other countries.

If the parcel is delivered in France and if the recipient is absent, a non-delivery notice will be left, informing The Customer that the parcel has been left at the nearest depot. An email will also be sent giving details of when the parcel will be available. The parcel will be handed over on production of valid proof of identity.

Details of shipping costs are given at the time the order is placed. They depend on the type of product (weight, size, etc.) and the country for delivery. Prices given are in euros and include taxes.

On receipt of the parcel, it is the responsibility of the recipient Customer to verify that the goods comply and to note any shipping related damage on the delivery note. Where there is recognised damage, The Customer must send in a claim by registered letter with acknowledgement of receipt within seven days of receiving of the parcel. The claim should be sent to the following address: SCSC – Service Consommateurs – 55 rue Deguingand – 92689 Levallois-Perret Cedex – France.

Items must be returned to The Company in their original condition within the same period, or the claim may not be accepted. Shipping costs are at The Company’s expense, so The Customer must include the receipt for the cost of return shipping of the parcel. These costs will then be refunded. The Company accepts no liability for delays to delivery due to unforeseen shipping issues beyond its control.

Article 10 – Product refunds

Product refunds in the cases mentioned in Articles 6, 8 and 9 will be made within 30 days of receipt of the goods by The Company. Refunds will be made in the form of credit directly to the bank account in the name of The Customer who placed the order. No returns sent on a Cash on Delivery basis will be accepted under any circumstances.

Article 11 – Filing and evidence

The Company will file order forms and invoices in a reliable and durable format, serving as an acceptable copy under the terms of article 1348 of the civil code. The Company’s computer files will be considered by the parties as proof of communications, orders, payments and transactions carried out between them.

Article 12 – Stipulations of the Data Protection Act

The recording of personal information for the purposes of mail order sales is obligatory, as this information is essential for the processing and shipping of orders, as well as drawing up invoices and guarantees. Failure to store the information invalidates the order. In compliance with French Data Protection Law, the processing of personal information relating to The Customer is subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL – National Commission on Computerised Data and Freedom). In compliance with article 34 of the Act passed on 6 January 1978, Customers have the right to access, modify, rectify or delete their personal data. They are entitled to exercise this right with respect to The Company.

Article 13 – Intellectual Property

The site and its content are, and remain, the exclusive intellectual property of The Company. Use of the site is limited to consultation, editing and or printing of any or all of the site for strictly personal and private purposes. No authorisation is given to reproduce, operate, repeat, modify or include for any purposes whatsoever, even partially, items from the site, whether software, visual or audio. Failure to observe these rules may result in civil or criminal proceedings against those responsible.
